Tha is just ridiculous. It sounds like a pretty archaic, although obviously cost effective, law which enables the state to prosecute an inanimate object. Whatever happened to 'innocent unless proven guilty'?

That is criminal law


In civil law once they take it, it is in their possession. You then have to prove it is yours, and that you obtained it legally to get it back.

Ah, I think it is the same here. In a civil law case, I know that a verdict can be reached on the basis of probability, but I don't know about the seizure of evidence.
